In a latest decision the Allahabad High Court has declared as illegal one of the eligibility provisions introduced by the Uttar Pradesh Higher education Service Commission. The provision had made prior experience mandatory in order to appear for recruitment tests for the post of lecturer.
Justice Ran Vijay Singh of Allahabad High Court, comprehending the gravity of the case, said that many students who appeared in the UP Board examination have been victimized as their answer books got changed. The Court directed the UP Board to award average marks to all the victimized students within three weeks. The judgement was given on the writ petition filed by one of those students whose answer book was changed.

The Uttar Pradesh government has filed an appeal before the Supreme Court on Monday challenging the Lucknow Bench of the Allahabad High Court’s order staying the imposition of 50 percent reservation for students belonging to Scheduled Castes (SC), Scheduled Tribes (ST) and Other Backward Castes (OBC) in private technical colleges.
The Lucknow Bench of the Allahabad High Court on Saturday stayed 50 per cent reservation in private engineering colleges affiliated with Uttar Pradesh Technical University (UPTU) as per a Government Order (GO) issued last month.
The Lucknow Bench of the Allahabad High Court, on Monday, has stayed the admission of a public interest litigation (PIL) that challenged the implementation of 50 percent reservation in private engineering colleges in Uttar Pradesh till September 3 and banned the admission process in engineering colleges affiliated to the Uttar Pradesh Technical University (UPTU). The Uttar Pradesh government has ordered all non-government engineering and management colleges across the state to resume quota for the Scheduled Castes (SC), Scheduled Tribes (ST) and Other Backward Communities (OBC).
It might be noted that following the approach by some private college owners before the Allahabad High Court in May this year for a stay after initially agreeing in 2006 to reserve seats for the students belong to the SC/ST and OBC communities, the reservation was suspended.
